Lee Seung-hwan "12% per annum delayed interest on performance cancellation damages"... publicly criticized Gumi City appeal
Singer Lee Seung-hwan criticized the city of Gumi's appeal policy after winning the first round of a damages lawsuit over the cancellation of a concert in Gumi in late 2024.
"Requiring a pledge is illegal, canceling a concert is illegal, and irresponsibility for not taking safety measures is also illegal," Lee Seung-hwan wrote on his social media on Jan. 1, referring to the first court ruling and announcing that Gumi City had decided to appeal the ruling in favor of some of the plaintiffs in the first trial.
"The rate of delayed damages is 12% per year," he said, adding, "Gumi's tax dollars are being used to pay for lies. It's a waste. All the lies that Mr. Jang Ho told in the TV debate will be used against him in court. I think the amount of compensation will be increased."
Earlier, the Gimcheon District Court's Gimcheon Civil Settlement Division ruled in favor of part of the plaintiffs in a 250 million won ($200,000) damages lawsuit filed by Lee Seung-hwan, his agency Dream Factory Club, and 100 concertgoers against the city of Gumi and Gumi Mayor Kim Jang-ho on March 8.
The court ruled that Gumi City must pay 35 million won to Lee Seung-hwan, 75 million won to Dream Factory Club, and 150,000 won to each of the 100 ticket holders. However, it did not recognize Mayor Kim Jang-ho's personal liability for damages. The total amount of compensation is approximately 125 million won.
At the time, Lee Seung-hwan stated that he would accept the first court ruling and not appeal if Mayor Kim Jang-ho apologized publicly, but he did not, and eventually formulated an appeal policy.
Gumi City, on the other hand, has maintained its stance that it will decide to appeal and seek a second opinion from the court.
At the Gumi mayoral candidate debate held on the 26th of last month, Gumi Mayor Kim Jang-ho claimed, "We never blocked Lee Seung-hwan's performance and permission was granted when he applied for the venue," adding, "In the past, there were political remarks during the performance and expressions that seemed to ridicule or sneer at Gumi citizens through social media."
"The decision to cancel was made based on the judgment that the lives and safety of citizens are the top priority, and the decision was reviewed by an expert committee twice. As the appeal is currently underway, we will seek the court's judgment again."
Meanwhile, the lawsuit began when Lee Seung-hwan's concert "HEAVEN," which was scheduled to be held on December 25, 2024, at the Gumi Arts Center, was abruptly canceled two days before the performance.
At the time, the city of Gumi canceled the venue, citing safety concerns and the possibility of opposition rallies by some civic groups, and demanded a pledge from Lee Seung-hwan that he would not engage in "political incitement and politically misleading speech." Lee Seung-hwan's refusal led to the final cancellation of the concert.
